Summary
Disability-related claims are at an all time high. The U.S. Equal Employment Opportunity Commission (EEOC) recently reported a 17 percent increase in disability charges in 2010, and such claims now account for about a third of all discrimination charges filed in California. Within these numbers, a more disturbing trend exists -- a steep rise in claims alleging discrimination based on mental disability. Managing employees with mental disabilities is one of the most challenging issues in today's workplace. Employees are understandably reluctant to disclose their conditions and the law limits an employer's ability to ask. Without a meaningful dialogue, however, it is virtually impossible to engage in the interactive process much less find a reasonable accommodation. In this web seminar, we will focus on federal and California disability statutes and cases, examining what types of conditions are entitled to protection, what actions an employer can take if it suspects an employee has a mental disability, and practical strategies for exploring accommodations. Topics we will cover in-depth include:
